Clear commercial terms for AWE projects, payments, delivery, ownership, cancellations and consumer rights.

These Terms & Conditions apply to services supplied by American Web Express (AWE). They work together with the proposal, statement of work, invoice, order confirmation and any written project-specific terms accepted by the customer. If a project-specific document conflicts with these website terms, the project-specific document controls to the extent permitted by law.

1. Services and scope

AWE provides creative, digital and technology services including branding, graphic design, UI/UX, web and application development, SEO, animation, video production, AI automation, AI bots and vehicle-wrap design. The exact deliverables, milestones, revision allowance, timeline and price are defined in writing before or during the engagement.

2. Quotes, deposits and payment

Website prices are starting prices unless a written proposal states that a price is fixed. Deposits, milestone payments, final balances, taxes and approved third-party expenses are due according to the applicable proposal or invoice. AWE may pause work where an undisputed payment is overdue.

3. Customer responsibilities

The customer must provide accurate instructions, timely feedback, approvals, content, credentials and lawful rights to any logos, photographs, text, trademarks, data or other materials supplied to AWE. Delays in these items may move delivery dates.

4. Revisions, changes and approvals

Included revision rounds are those stated in the agreed scope. A new creative direction, extra deliverables, additional revision rounds or work requested after approval may be treated as a change in scope and quoted separately. Approval may be recorded by email, project platform, signed document or another agreed written method.

5. Timelines and dependencies

Delivery dates are estimates unless expressly guaranteed in writing. Timelines may be affected by customer delays, platform reviews, hosting, APIs, print vendors, shipping, advertising platforms, software providers and other dependencies outside AWE's reasonable control.

6. Intellectual property

Subject to full payment, rights in final bespoke deliverables transfer or are licensed as stated in the project agreement. AWE retains ownership of its pre-existing methods, templates, know-how, reusable code, internal systems and tools. Third-party fonts, stock media, software, plugins and other licensed assets remain subject to their own licence terms.

7. Portfolio use

Unless confidentiality is agreed in writing, AWE may display completed public-facing work for portfolio, award, social media and marketing purposes after launch or public release. Confidential customer information will not be intentionally published.

8. Third-party services and production

Hosting, domains, software subscriptions, stock assets, APIs, advertising spend, print production, shipping and other third-party costs may be billed separately. AWE is not responsible for a third party's independent outages, policy changes or service failures, although AWE will reasonably assist with issues within the agreed scope.

9. Service standard and correction

AWE will perform services with reasonable care and skill. If work materially fails to match the agreed written scope, the customer should notify AWE promptly and provide reasonable detail so AWE can review the issue and, where appropriate, correct or repeat the affected work. Nothing in these terms limits any non-waivable remedy available under applicable consumer law.

10. Refunds and cancellations

Refunds and cancellations are governed by the Return & Refund Policy and Cancellation Policy. AWE's 70% satisfaction refund is a contractual goodwill remedy for eligible subjective-dissatisfaction cases; it does not replace stronger statutory rights that may apply where services are defective, misdescribed or otherwise legally non-conforming.

11. UK consumer rights

If you are a UK consumer purchasing at a distance, you may have a statutory 14-day cancellation right for many service contracts. If you expressly ask AWE to begin work during that period and then cancel before completion, applicable law may require payment for the proportion of services already supplied. If the service is fully performed during the cancellation period after the required request and acknowledgement, the statutory cancellation right may end. Your rights under the Consumer Rights Act 2015, including rights relating to reasonable care and skill and statutory remedies, are not excluded.

12. United States consumers

U.S. consumer rights vary by state and by the type and place of sale. These terms do not waive rights that cannot legally be waived under applicable federal or state law. The FTC's federal Cooling-Off Rule applies to certain qualifying sales made at a consumer's home or certain temporary locations and is not a general cancellation right for ordinary online professional-service purchases.

13. Limitation of liability

To the maximum extent permitted by law, AWE is not liable for indirect, incidental or consequential loss, loss of profit, loss of opportunity, loss caused by customer-supplied material, or failures of third-party platforms. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or other non-excludable statutory liability.

14. Suspension and termination

AWE may suspend or terminate an engagement for material non-payment, unlawful or abusive conduct, material breach, or persistent failure to provide essential project inputs. Any accrued rights, completed-work charges and non-cancellable third-party commitments remain payable to the extent permitted by law.

15. Governing law

For business-to-business engagements, unless the written project agreement states otherwise, these terms are governed by the laws of England and Wales and the courts of England and Wales have jurisdiction. If you are a consumer, this clause does not remove mandatory protections or jurisdiction rights you have under the law of the country or U.S. state in which you reside.
